Terms and Conditions

 

1. Our Agreement

All work is performed under a written contract or detailed estimate that becomes binding once signed by both parties. The contract will clearly outline the scope of work, materials, timeline, and total price. Any changes or additional work must be agreed upon in writing via a change order.

2. Pricing and Payment

  • Our quotes are valid for 30 days from the date of issuance.
  • Prices include all labour and materials specified in the contract.
  • A deposit is required to schedule your project (typically 30–50%, depending on project size).
  • The balance is due upon substantial completion of the work, unless otherwise agreed.
  • We accept payments by cash, cheque, e-transfer, or credit card (processing fees may apply).
  • Late payments may be subject to interest at 2% per month (24% per annum).

Under Ontario’s Consumer Protection Act, if an estimate is provided, the final cost will not exceed the estimate by more than 10% unless you approve additional work or changes.

3. Warranty

We stand behind our work with a 5-year workmanship warranty on all installations. This warranty covers defects in our installation and labour under normal use.

It does not cover:

  • Natural material issues such as warping, splitting, cupping, twisting, or cracking of wood
  • Damage caused by weather, animals, improper maintenance, or alterations by others
  • Manufacturer defects in materials (we will assist you with manufacturer claims where applicable)

Any warranty claim must be submitted in writing within the warranty period. We will inspect and, at our discretion, repair or replace defective workmanship at no cost to you.

4. Site Preparation and Customer Responsibilities

To ensure a smooth and safe installation:

  • You are responsible for clearly marking property lines, underground utilities (call Ontario One Call), and any buried items.
  • Please remove or relocate any obstacles (plants, decorations, furniture, etc.) along the work area before we arrive.
  • We assume no liability for damage to items not moved or for fence placement if property lines are not accurately identified.
  • You must obtain any required municipal permits (we can advise but the responsibility for permits lies with the property owner unless otherwise stated in the contract).

5. Timeline and Delays

We will provide an estimated start and completion date in your contract. Timelines can be affected by weather, material availability, permit delays, or unforeseen site conditions. We will communicate any changes promptly.

6. Satisfaction and Changes

Your satisfaction is our priority. If something is not as agreed, please let us know immediately so we can address it. We strive to exceed expectations through attention to detail and creative solutions that deliver lasting value.

7. Limitation of Liability

We are not responsible for consequential damages, loss of use, or any issues arising from factors beyond our control (e.g., extreme weather, acts of God, or pre-existing site conditions). Our liability is limited to the value of the contract.

8. Cancellation and Cooling-Off Period

If you signed the contract in your home (or after a home visit), Ontario law gives you a 10-calendar-day cooling-off period to cancel for any reason. After that period, cancellations may result in forfeiture of the deposit to cover materials already ordered or scheduled labour.

9. Governing Law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes will be resolved in the courts of Lambton County or the City of Sarnia.
